Privacy Policy

Smart Business Visibility respects your privacy and aims to handle personal information lawfully, fairly and transparently. This Privacy Policy explains how personal information may be collected, used, stored and shared when you visit this website, contact us, request a quotation, or use our website and digital visibility services.

1. Who is responsible for your information

Smart Business Visibility is operated by Arif Bukera in Nairobi, Kenya. For personal information collected directly through this website and our business enquiries, Smart Business Visibility generally determines why and how that information is used. Some third-party providers, such as hosting, communications, analytics or payment providers, may process information independently under their own terms and privacy notices.

2. Information we may collect

Depending on how you interact with us, we may collect:

  • Your name and business or organisation name.
  • Phone number, WhatsApp number and email address.
  • Business location, website and social-media details.
  • Information about your services, products, customers and project requirements.
  • Logos, photographs, reviews, business descriptions and other materials you voluntarily provide for a project.
  • Messages, quotations, approvals and other project correspondence.
  • Payment or transaction references where relevant.
  • Technical information generated through website hosting, security, server logs or analytics, such as IP address, device type, browser information and pages visited.

We aim to collect only information reasonably necessary for the relevant purpose.

3. How we collect information

Information may be collected when you contact us through WhatsApp, phone or email; submit a website form where available; request a quotation; provide information for a project; communicate during a project; or visit and interact with this website.

4. Why we use information

We may use personal information to:

  • Respond to enquiries and prepare quotations or proposals.
  • Understand, scope, build, review, launch or maintain an agreed website or digital service.
  • Communicate about projects, revisions, payments and support.
  • Maintain appropriate business, contractual, accounting and tax records.
  • Protect websites, accounts and systems from misuse, fraud or security threats.
  • Measure and improve website performance, search visibility and customer experience where analytics tools are used.
  • Comply with applicable legal or regulatory obligations.

5. Lawful basis and consent

Depending on the circumstances, processing may be necessary to respond to a request before entering into a contract, to perform an agreed service, to comply with a legal obligation, for a legitimate business interest that does not improperly override your rights, or because you have given consent. Where processing relies on consent, you may withdraw that consent, subject to applicable law and any lawful reason for retaining information.

6. WhatsApp, telephone, email and social platforms

Smart Business Visibility uses WhatsApp, telephone, email and social platforms as communication channels. When you use a third-party communication service, that provider may process information under its own privacy terms. Please avoid sending highly sensitive personal information through ordinary messaging or email unless it is genuinely necessary for the service.

7. Client content and account access

Clients may provide business information, photographs, testimonials, product details, domain or hosting information and account access required for an agreed project. Clients are responsible for ensuring they have the right or permission to provide materials and personal information supplied for publication or processing. Login credentials should be shared only where necessary and should be changed or revoked when access is no longer required.

8. Payments

Payments may be made through M-Pesa, PayPal, bank, card or another agreed provider. A payment provider may independently process information needed to complete a transaction. Smart Business Visibility does not require customers to send full bank-card details through ordinary WhatsApp messages, email or website contact forms. Transaction references and payment records may be retained for contractual, accounting, fraud-prevention or legal purposes.

9. Cookies, analytics and technical data

This website may use cookies or similar technologies for essential functionality, security, performance, preferences and, where enabled, analytics or marketing. Please see our Cookie Policy for more information. Where applicable law requires consent for non-essential technologies, those technologies should be configured to respect the visitor’s consent choice.

10. Hosting and service providers

The website uses third-party infrastructure and may use providers for hosting, domains, email, backups, security, analytics, communications or payments. At the time of this policy, the website is hosted using Hostinger services. Providers should receive only the information reasonably necessary for the relevant service.

11. When information may be shared

Personal information may be shared where reasonably necessary with hosting or technical providers, communications providers, payment providers, professional advisers, contractors working on an agreed project, or public authorities where disclosure is required by law. We do not sell personal information to advertisers.

12. International processing

Some hosting, communications, analytics or payment providers may process information using infrastructure outside Kenya. Where personal information is transferred internationally, appropriate safeguards should be used as required by applicable data-protection law.

13. Data retention

Personal information is retained only for as long as reasonably necessary for the purpose for which it was collected or where continued retention is required for legitimate contractual, accounting, security or legal purposes. Information that is no longer required should be deleted, anonymised or otherwise securely disposed of where appropriate.

14. Your data-protection rights

Subject to applicable law and lawful limitations, you may have rights to be informed about the use of your information; access information held about you; object to certain processing; request correction or deletion; request restriction; withdraw consent where consent is the basis of processing; and request data portability where applicable.

15. Direct marketing

Where personal information is used for direct marketing, Smart Business Visibility will aim to provide a clear, accessible way to opt out. If you ask us to stop direct marketing, we will respect that request subject to any communications still required for an active contract, transaction or legal obligation.

16. Security

We use reasonable organisational and technical measures intended to protect personal information against unauthorised access, disclosure, loss, misuse, alteration or destruction. No internet transmission, website, email service or digital-storage system can be guaranteed to be completely secure.
